These Terms and Conditions ("Terms") govern access to and use of the WaveStaq website ("Site"), operated by Andrea Berni (VAT no. 04225350364, registered office Strada Cavo Argine 34/6, 41121 Modena (MO), email info@wavestaq.com) — hereinafter the "Controller".
Access to and use of the Site implies full acceptance of these Terms. If you do not accept even a single clause, please do not use the Site.
What to know at a glance
- 🌐 The Site is an informational showcase for the professional services offered by the Controller. It does not sell products nor deliver paid services directly online.
- ✉️ The only active form of contact is the contact form, governed by the Privacy Policy.
- 📝 The contents of the Site (texts, images, code, graphics) are owned by the Controller and protected by copyright.
- ⚖️ The relationship is governed by Italian law; jurisdiction: Court of Modena (subject to mandatory consumer protection rules).
- 🔄 The Controller may modify the Site or these Terms at any time. Previous versions remain available upon request.
Subject
The Site provides information about the Controller's professional activities, services and portfolio. Use of the Site is free and does not require registration or account creation.
Any contractual relationship between the Controller and the user arises outside the Site (e.g. through email exchange, signed contract, accepted quote) and is governed by separate agreements.
Conditions of use
By using the Site, the user undertakes to:
- Not violate any applicable law (Italian, EU or international)
- Not interfere with the normal functioning of the Site (e.g. through attacks, bots, mass scraping, unauthorised access attempts)
- Not use the Site for unlawful, fraudulent, defamatory or threatening purposes
- Not reproduce or distribute Site content without written authorisation from the Controller
- Not bypass the technical security measures of the Site
The Controller reserves the right to block access (including by IP address) to anyone violating these conditions or acting in a prejudicial manner.
Contact form
The Site provides a contact form to request information. Submitting the form:
- Involves the processing of the data provided (name, email, message) as described in the Privacy Policy
- Is subject to anti-spam verification via Google reCAPTCHA
- Does not constitute a contractual offer nor commit the Controller to provide any service
The Controller reserves the right not to respond to manifestly promotional, automated or offensive messages.
Intellectual property
All Site content — including by way of example:
- Texts, articles, service descriptions
- Images, photographs, illustrations, logo
- HTML/CSS/JavaScript front-end source code
- Layout, graphic structure, design
- Any downloadable documents
is the exclusive property of the Controller or used under regular licence (e.g. open source fonts, Creative Commons or purchased images). They are protected by Italian and international copyright laws (Italian Law 633/1941 as amended, EU Regulation 2019/790) and by trademark legislation.
Any reproduction, duplication, copying, sale, resale or commercial exploitation of Site contents is prohibited without the prior written consent of the Controller.
Personal use of contents (e.g. saving for offline consultation, sharing with a single colleague) is permitted provided that references to the author are maintained and there is no commercial purpose.
Links to external sites
The Site may contain links to third-party websites (e.g. social networks, service providers, partners). The Controller:
- Does not control nor is responsible for the content of linked sites
- Does not guarantee their availability or security
- Is not liable for any damage arising from the use of third-party sites
Users are advised to read the terms and privacy policies of destination sites.
Limitation of liability
The Controller undertakes to provide the Site "as is", doing its best to ensure proper functioning. However, to the extent permitted by law, the Controller:
- Does not guarantee that the Site will always be accessible, uninterrupted, error-free or virus-free
- Is not liable for any interruption due to scheduled maintenance, updates, force majeure events (e.g. hosting provider failures, network outages)
- Is not liable for indirect damages, lost profits, data loss or reputational damage arising from the use or inability to use the Site
- Does not guarantee the perfect accuracy, completeness or up-to-date nature of published information, which has purely informational value and does not constitute professional advice

These limitations do not apply in cases of wilful misconduct or gross negligence by the Controller, nor where the law imposes a higher level of liability (e.g. in relations with consumers under Italian Legislative Decree 206/2005 — Consumer Code).
Indemnification
The user agrees to indemnify and hold harmless the Controller from any claim, loss, cost or expense (including reasonable legal fees) arising from:
- Violation of these Terms by the user
- Improper or unlawful use of the Site by the user
- Violation of third-party rights committed by the user through the Site
Privacy
The processing of personal data collected through the Site is governed by the Privacy Policy and the Cookie Policy.

Changes to Terms
The Controller reserves the right to modify these Terms at any time, for instance to align them with new regulations, technical updates of the Site or changes in the services offered.
Modifications take effect upon publication on the Site. The date of last modification is shown at the top of the document.
Continued use of the Site after the publication of changes constitutes tacit acceptance of the new Terms. If you do not accept the changes, you are invited to discontinue use of the Site.
The history of previous versions is kept by the Controller and available upon written request.
Assignment
The Controller may assign or transfer the rights and obligations arising from these Terms to third parties (e.g. in case of extraordinary operations such as mergers, acquisitions, business transfers), provided that equivalent levels of user protection are guaranteed.
The user may not assign their rights or obligations without the prior written consent of the Controller.
Severability
If any clause of these Terms were declared null, illegitimate or unenforceable by a competent authority, the remaining clauses will retain full validity and effectiveness. The contested clause will be replaced by an equivalent provision that respects the original intent of the parties within the limits of the law.
Applicable law and jurisdiction
These Terms are governed by Italian law.
For any dispute arising from these Terms or from use of the Site, the Court of Modena (Italy) shall have exclusive jurisdiction, subject to the mandatory rules on consumers (Art. 66-bis of the Italian Consumer Code), which provide for the mandatory jurisdiction of the court of the consumer's place of residence or domicile.
For users residing in the European Union, as an alternative to ordinary court proceedings, the European Commission's ODR (Online Dispute Resolution) platform is available for the out-of-court settlement of online disputes: ec.europa.eu/consumers/odr.

Definitions
Site: the WaveStaq website accessible at the main address and its sub-pages.
Controller: Andrea Berni, natural person with VAT no. 04225350364, legally responsible for the management of the Site.
User: any natural person who accesses the Site, regardless of the reason for access.
Content: any material present on the Site, including texts, images, code, graphics, videos, documents.
Force majeure: unforeseeable and unavoidable events beyond the reasonable control of the Controller (natural disasters, wars, government acts, strikes, hosting provider or telecommunications network outages).
Consumer: a natural person acting for purposes outside their entrepreneurial, commercial, craft or professional activity (Art. 3, letter a, Italian Consumer Code).
